Credit Block Terms of Service

These Terms and Conditions (the “Terms”) are a legally binding agreement between Regal Credit Management, (“Regal Credit Management,” “we” “our” or “us”) and you (“you,” “your” or “yours”), and describe the terms under which you may use Regal Credit Management (the “Service”). You must agree to these Terms to use the Service; if you do not agree to all or any part of these Terms, you must not register for or use the Service.

These Terms apply only to your use of Regal Credit Management. Other products and services offered by Regal Credit Management are subject to different terms.

ARTICLE 1. Regal Credit Management

  1. Credit Block, by Regal Credit Management is the process of implementing a security freeze on a Client’s credit file with Equifax, Transunion and Experian, which prevents inquiries from third parties, such as credit grantors and other companies. With a Regal Credit Management, lenders are virtually blocked from gaining access to Client’s credit report unless given permission.
  2. Where requested by the Client, Regal Credit Management shall place a Credit Block on Client’s credit profile with Transunion, Equifax and Experian. In addition, when Client requires a company to have access to his or her credit profile Client can request that Regal Credit Management temporarily unfreeze Client’s credit file for a period of time, or for a specific company.
  3. The Regal Credit Management program continues indefinitely until notified by Client to end program. If Client wants to terminate this Agreement and end the Credit Block program, Client must give Regal Credit Management a 30-day notice by mailing the cancellation form or a written request to cancel to: Regal Credit Management, 1270 Avenue of the Americas, 7th Floor, New York, NY 10020.
  4. Client acknowledges that even with Regal Credit Management, Client’s credit file will still be disclosed in certain situations, such as companies already doing business with Client and collection agencies working for creditors. This will not prevent creditors from reporting negative information to the credit bureaus. By checking the box on the enrollment form the Client is opting into Regal Credit Management;s Credit Block program.

ARTICLE 2. CLIENT’S OBLIGATIONS

  1. Client hereby agrees to provide Regal Credit Management with all necessary information including all credit bureau correspondence, security pins mailed to client directly, proof of social security number, proof of address within 72 hours as required by the credit bureaus to complete the services under this Agreement.
  2. Client agrees to execute a Limited Power of Attorney authorizing Regal Credit Management to contact the creditors and bureaus, and/or implement a security freeze on Client’s behalf. In addition, Client authorizes Regal Credit Management to receive and obtain credit reports from each of the three credit bureaus (Transunion, Equifax and Experian) via Wire International Realty and agrees not to dispute the inquiry.
  3. Client acknowledges that in the event Client wishes to apply for a credit line or obtain financing, the financial institution will be unable obtain Client’s credit report in the event Client has enrolled in the Credit Credit Block Program. If Client needs access to his or her credit report, Client must make a request to Regal Credit Management by emailing help@mycreditblock.com for the Credit Block to be lifted for a specific period of time or creditor.

ARTICLE 3. THIRD PARTY OPT-OUT

If you enroll in Credit Block, Regal Credit Management will make reasonable efforts to, on your behalf and at your request, opt you out of certain third party databases and websites (the “ Third Party Sites ”). For other Third Party Sites, we may provide you with instructions on how to opt out yourself. This includes www.optoutprescreen.com and may include updating your address with the credit bureaus as necessary.

You are required to comply with the terms and conditions for any such Third Party Site when you submit an opt out to a Third Party Site. As noted below, you also authorize us to agree to the applicable terms and conditions for any Third Party Site to which we submit an opt out on your behalf.

By “opt out” or “opt you out,” we mean that we will take efforts to request, that a Third Party Site remove or suppress your personal information from its databases or public-facing pages or restrict or limit the disclosure of your personal information, including by attempting to

  1. have your information removed from one or more databases operated by a Third Party Site,
  2. have your information suppressed in whole or in part from being shared by a Third Party Site,
  3. have your information suppressed in whole or in part from being disclosed publicly by a Third Party Site, or
  4. otherwise limit the disclosure of your personal information by a Third Party Site. The extent of the opt-out we submit or attempt to submit on your behalf varies by Third Party Site, and depends on the terms and the practices established by each Third Party Site. Similarly, the extent of the opt outs that we provide instructions for exercising will vary by Third Party Site.

ARTICLE 4. LIMITED AUTHORITY TO ACT ON YOUR BEHALF

In order to opt you out, we may need to interact with Third Party Sites on your behalf. You expressly authorize Regal Credit Management, its agents, and its employees, to act as your personal representative in order to submit opt outs to Third Party Sites and otherwise implement the Service, including by acting to:

  • obtain information on your behalf;
  • submit your personal information to the Third Party Sites;
  • communicate with the Third Party Sites or other third parties on your behalf;
  • create an account in your name with the Third Party Sites;
  • agree to applicable terms and conditions imposed by these Third Party Sites;
  • complete and sign or execute documents on your behalf; and
  • take other actions that Regal Credit Management believes is reasonably necessary to opt you out of a Third Party Site or implement the Service.

You are prohibited from granting us or purporting to grant us authority to act on behalf of any person other than yourself unless you have written permission from the individual you are enrolling.

ARTICLE 5. ACCURACY OF YOUR INFORMATION

As noted, in order to opt you out and in order to search for your records, we may need to collect, as well as submit to Third Party Sites, certain personal information about you. You agree to provide accurate and complete information to us, and you represent and warrant that all of the information you submit to us in connection with the Service is true, and relates to you, not another person. If you give us information that we know, discover or suspect is false or inaccurate, or relates to another person, we may suspend or terminate your access to the Service and reserve the right to, where we deem it appropriate, report such conduct to law enforcement and other third parties, and to cooperate in the investigation of such conduct.

ARTICLE 6. Array and Credit Monitoring.

You understand that by clicking on the “Enroll” button and signing up for services, you are providing “written instructions” to Regal Credit Management and its employees, agents, subsidiaries, affiliates, contractors, third party data sources and suppliers, and all other credit reporting agencies under the Fair Credit Reporting Act (FCRA), as amended, to access your credit files from each national credit reporting agency and to exchange information about you with each such national credit reporting agency in order to verify your identity and to provide the products and/or services to you. You agree and hereby authorize Regal Credit Management, its agents and employees, to provide your personally identifiable information (or, if applicable, information about your child you have enrolled) to third parties as provided in our Privacy Policy, as may be amended from time to time, You waive any and all claims against Regal Credit Management and its agents and employees for the acts or omissions of these third parties with regard to the use or disclosure of such information. Your further authorize Regal Credit Management and its agents and employees to obtain various information and reports about you (or about your child that you have enrolled, if applicable) in order to provide the products and/or services, including, but not limited to, address history reports, name and alias reports, criminal reports or sex offender reports, and to provide monitoring and alerts.

ARTICLE 7. PRIVACY POLICY.

  1. Regal Credit Management will not disclose any information about Client to anyone, except as permitted by Client. Access and dissemination of Client’s personal information will be restricted to those individuals who need to know such information in providing service to Client, such as Account Managers, Coordinators, Client’s Wealth Advisor, Banker or Accountant, as authorized by client.
  2. To protect Client’s personal information from unauthorized access and use, Regal Credit Management uses security measures that comply with federal law. Regal Credit Management employs numerous physical, electronic and operational procedures to ensure the security of Client’s personal information.
  3. While enrolling for the products and/or services, we will ask you for the following types of information: contact information (such as name, address, phone number, and email address); sensitive information (such as date of birth, driver’s license number and social security number); personal information to verify your identity and financial information (such as credit card number). This information is required in order to verify your identity, charge you the agreed upon fees for our products and services, and to fulfill our obligation to provide our products and services to you, including communicating with third parties as necessary to provide such products and services, such as identification verification companies, consumer reporting agencies, payment validation companies, law enforcement agencies, or others.
