Credit Block Terms of Service

These Terms and Conditions (the “Terms”) are a legally binding agreement between Regal Credit Management, (“Regal Credit Management,” “we” “our” or “us”) and you (“you,” “your” or “yours”), and describe the terms under which you may use Regal Credit Management (the “Service”). You must agree to these Terms to use the Service; if you do not agree to all or any part of these Terms, you must not register for or use the Service.

These Terms apply only to your use of Regal Credit Management. Other products and services offered by Regal Credit Management are subject to different terms.

ARTICLE 1. Regal Credit Management

  1. Credit Block, offered by Regal Credit Management, is the process of limiting access to a Client’s credit file to prevent inquiries from third parties such as credit grantors or other institutions. With Regal Credit’s Credit Block ™ , lenders are effectively restricted from viewing a Client’s credit report unless expressly authorized.
  2. Where requested by the Client, Regal Credit Management will implement the Credit Block on the Client’s credit file. When the Client requires access to their credit file to be granted to a specific company or for a designated period of time, they may request that Regal Credit Management lift the Credit Block accordingly.
  3. The Credit Block program will remain active indefinitely unless and until Regal Credit Management receives a 30-day written notice from the Client to cancel. Clients must submit the cancellation form or a written request to terminate the program to: Regal Credit Management, 1270 Avenue of the Americas, 7th Floor, New York, NY 10020.
  4. Clients acknowledge that even with the Credit Block in place, certain disclosures may still occur, including to companies with which the Client has an existing relationship or to agencies acting on behalf of creditors. This program also does not prevent the reporting of negative credit information.
  5. By checking the box on the enrollment form, the Client agrees to participate in Regal Credit Management’s Credit Block program.

ARTICLE 2. CLIENT’S OBLIGATIONS

  1. Client hereby agrees to provide Regal Credit Management with all necessary information including any correspondence, access codes mailed directly to the Client, proof of social security number, and proof of address within 72 hours as required by third-party credit data providers to complete the services under this Agreement.
  2. Client agrees to execute a Limited Power of Attorney authorizing Regal Credit Management to contact relevant third-party financial institutions, other relevant parties, and/or implement the Credit Block on Client’s behalf. In addition, Client authorizes Regal Credit Management to receive and obtain credit reports from each national credit data provider via Array.
  3. Client acknowledges that in the event they wish to apply for a credit line or obtain financing, the financial institution will be unable to obtain their credit report while the Client is enrolled in the Credit Block program. If the Client needs access to their credit report, they must make a request to Regal Credit Management by emailing creditblock@regalcredit.com for the Credit Block to be lifted for a specific period of time or for a specified creditor.

ARTICLE 3. THIRD PARTY OPT-OUT

If you enroll in Credit Block, Regal Credit Management will make reasonable efforts to, on your behalf and at your request, opt you out of certain third-party databases and websites (the “Third Party Sites”). For some Third Party Sites, we may provide you with instructions on how to opt out yourself.

You are required to comply with the terms and conditions of any such Third Party Site when you submit an opt-out request. You also authorize Regal Credit Management to agree to the applicable terms and conditions for any Third Party Site to which we submit an opt-out on your behalf.

By “opt out” or “opt you out,” we mean that we will take efforts to request that a Third Party Site remove or suppress your personal information from its databases or public-facing pages, or restrict or limit the disclosure of your personal information, including by attempting to:

  • have your information removed from one or more databases operated by a Third Party Site,
  • have your information suppressed in whole or in part from being shared by a Third Party Site,
  • have your information suppressed in whole or in part from being disclosed publicly by a Third Party Site, or
  • otherwise limit the disclosure of your personal information by a Third Party Site.

The extent of the opt-out we submit or attempt to submit on your behalf varies by Third Party Site, and depends on the terms and practices established by each. Similarly, the extent of the opt-outs for which we provide instructions will vary by Third Party Site.

ARTICLE 4. LIMITED AUTHORITY TO ACT ON YOUR BEHALF

In order to opt you out, we may need to interact with Third Party Sites on your behalf. You expressly authorize Regal Credit Management, its agents, and its employees, to act as your personal representative in order to submit opt outs to Third Party Sites and otherwise implement the Service, including by acting to:

  • obtain information on your behalf;
  • submit your personal information to the Third Party Sites;
  • communicate with the Third Party Sites or other third parties on your behalf;
  • create an account in your name with the Third Party Sites;
  • agree to applicable terms and conditions imposed by these Third Party Sites;
  • complete and sign or execute documents on your behalf; and
  • take other actions that Regal Credit Management believes is reasonably necessary to opt you out of a Third Party Site or implement the Service.

You are prohibited from granting us or purporting to grant us authority to act on behalf of any person other than yourself unless you have written permission from the individual you are enrolling.

ARTICLE 5. ACCURACY OF YOUR INFORMATION

As noted, in order to perform opt-outs and search for your records, we may need to collect and submit certain personal information about you to Third Party Sites. You agree to provide accurate and complete information to Regal Credit Management and represent and warrant that all information submitted in connection with the Service is true, correct, and pertains to you — not another individual.

If we discover or suspect that any information you’ve provided is false, misleading, or relates to someone other than yourself without proper authorization, Regal Credit Management reserves the right to suspend or terminate your access to the Service. Where deemed appropriate, we may also report such conduct to law enforcement or other relevant third parties and cooperate with any related investigations.

ARTICLE 6. Array and Credit Monitoring.

You understand that by clicking the “Enroll” button and signing up for services, you are providing “written instructions” under the Fair Credit Reporting Act (FCRA), as amended, to Regal Credit Management and its employees, agents, affiliates, contractors, third-party data sources, and service providers to access your credit file for the purpose of verifying your identity and delivering services associated with the Credit Block.

You agree and authorize Regal Credit Management, its agents, and employees to provide your personally identifiable information (or, if applicable, information about a minor you have enrolled) to necessary third parties as described in our Privacy Policy, as may be amended from time to time. You waive any claims against Regal Credit Management and its agents or employees for the acts or omissions of those third parties relating to the use or disclosure of such information.

You further authorize Regal Credit Management and its agents to obtain various information and reports about you (or your enrolled dependent, if applicable) to provide the services, including but not limited to identity verification, address history, alias reports, and other public records, as well as provide monitoring and alert services related to your credit file.

ARTICLE 7. PRIVACY POLICY.

  1. Regal Credit Management will not disclose any information about Client to anyone, except as permitted by Client. Access and dissemination of Client’s personal information will be restricted to those individuals who need to know such information in providing service to Client, such as Account Managers, Coordinators, Client’s Wealth Advisor, Banker or Accountant, as authorized by client.
  2. To protect Client’s personal information from unauthorized access and use, Regal Credit Management uses security measures that comply with federal law. Regal Credit Management employs numerous physical, electronic and operational procedures to ensure the security of Client’s personal information.
  3. While enrolling for the products and/or services, we will ask you for the following types of information: contact information (such as name, address, phone number, and email address); sensitive information (such as date of birth, driver’s license number and social security number); personal information to verify your identity and financial information (such as credit card number). This information is required in order to verify your identity, charge you the agreed upon fees for our products and services, and to fulfill our obligation to provide our products and services to you, including communicating with third parties as necessary to provide such products and services, such as identification verification companies, consumer reporting agencies, payment validation companies, law enforcement agencies, or others
